These Submission Terms are part of, and incorporated into, our Terms of Service. By submitting anything to the Site, you agree to them.
By submitting anything to this Site — including stories, text, news tips, names, photos, images, audio, or video (together, your “Submission”) — you agree to the following. These Submission Terms are part of our Terms of Service, and our Privacy Policy also applies.
You irrevocably assign to Winterwolf Enterprises, LLC (“we,” “us,” “our”), and to the extent any right cannot be assigned you grant us, a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable and transferable right and license to use, copy, edit, adapt, modify, translate, publish, perform, display, distribute, monetize, and create derivative works from your Submission, in whole or in part, in any media now known or later developed, for any purpose including commercial purposes and including promotion of our shows and products, without payment, credit, or notice to you, forever.
To the maximum extent permitted by law, you waive, and agree not to assert against us or anyone we authorize, any “moral rights,” rights of attribution or integrity, or similar rights you may have in your Submission.
We are not required to read, use, respond to, broadcast, or return any Submission. We may decline, edit, or remove any Submission at our discretion, including for any violation of these terms. Submitting does not guarantee your Submission appears anywhere.
If you provide a name, on-air name, photograph, voice, or likeness, you grant us the same rights in them, including use on our broadcasts, videos, website, and promotion. If you provide a preferred on-air name, we may use it instead of your real name, at our discretion.
You represent and warrant that: your Submission is your own original work, or you have all rights and permissions needed to grant the rights above; your Submission does not infringe or violate anyone’s copyright, trademark, privacy, publicity, or other rights; your Submission contains no confidential or private information about other people, and no one else’s personal information; your Submission is not defamatory, obscene, harassing, hateful, threatening, or unlawful, and does not contain any sexual content involving minors or any content that exploits or endangers a child; and nothing in your Submission is submitted in expectation of payment, credit, or employment.
You may not submit anything that is illegal, infringing, defamatory, harassing, hateful, obscene, deceptive, or harmful; that contains malware; that reveals another person’s private information without permission; or that you do not have the right to submit. We may remove any Submission and report unlawful content to the authorities.
To the maximum extent permitted by law, you release Winterwolf Enterprises, LLC and its owners, members, managers, staff, contractors, and partners from any and all claims arising out of our use of your Submission, including claims of defamation, invasion of privacy, right of publicity, emotional distress, or lost economic opportunity.
You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your Submission or your breach of these Submission Terms, including any claim that your Submission infringes or violates a third party’s rights.
You will not receive, and will never be entitled to, any payment, royalty, credit, or other consideration for your Submission or our use of it.
Submissions are accepted only from persons 18 or older, or from a parent or legal guardian submitting on a minor’s behalf and agreeing to these terms for that minor. We do not knowingly accept Submissions from children under 13. If you are under 18, do not submit anything without your parent or guardian’s involvement and consent.
You understand that your Submission and the details in it may be used, adapted, and referenced in our broadcasts and content and in connection with automated or AI-assisted features and production tools, consistent with the license above.
Any dispute arising out of or relating to your Submission or these Submission Terms is subject to the binding arbitration agreement, class-action waiver, and 30-day opt-out set out in Section 20 of our Terms of Service, and is governed by the laws of the State of Nevada.
If any provision of these Submission Terms is found unenforceable, the remaining provisions remain in full force and effect. These Submission Terms, with our Terms of Service and Privacy Policy, are the entire agreement about Submissions.
